Terms of Service

1. Acceptance of these terms

By creating an account or using BrokerBolo (incorporation in progress under the same name; "we", "us"), you agree to these terms. If you're creating an account on behalf of a brokerage, you're confirming you have the authority to do so.

2. The service

BrokerBolo is a WhatsApp-native CRM built for rental brokerages. It requires you to connect your own WhatsApp Business number to send and receive messages. AI-assisted reply drafting is an optional feature that requires you to supply your own OpenAI or Anthropic API key.

3. Accounts and roles

Each brokerage operates one account with team members assigned a role — owner, admin, agent, or viewer. Roles control what a team member can see: for example, brokerage/ commission figures on a deal are visible only to owner- and admin-level users, not agents. Setting up roles correctly for your team is your responsibility.

4. Your data, your responsibility

You are solely responsible for:

• Having a lawful basis or consent for every lead, owner, tenant, or society contact you enter into BrokerBolo.
• Complying with WhatsApp/Meta's own Business and Commerce Policies for any messages you send through the platform.
• The accuracy of the data you enter.

BrokerBolo is not a party to your real-estate transactions and is not responsible for your MahaRERA or other regulatory obligations as a broker.

5. Acceptable use

You may not use BrokerBolo to send unlawful bulk messages or spam, to store or process data you do not have the right to hold, or to attempt to circumvent WhatsApp/Meta's messaging policies. Violating Meta's policies can get your WhatsApp number restricted or banned by Meta — a decision made by Meta, not by us, and outside our control.

6. AI features

AI-assisted reply drafting is optional and off by default. If you enable it, you supply and pay for your own API key, and any usage costs are yours. AI-drafted output can be inaccurate — you're responsible for reviewing a drafted message before it's sent to a customer.

7. Fees

BrokerBolo is offered on an annual or monthly paid plan — see our Pricing page for current rates. Refund terms, including which fees are non-refundable, are covered separately in our Refund Policy. We'll give notice before changing prices on an existing subscription.

8. Data ownership and portability

You own the data you enter into BrokerBolo. We process it only to provide the service to you. You can request an export or deletion of your data at any time, and we'll also provide it on account termination — see our Privacy Policy for how long we retain data.

9. Third-party dependencies

BrokerBolo relies on Meta's WhatsApp Cloud API, Supabase, and — if you enable it — OpenAI or Anthropic. We're not responsible for outages, policy changes, or pricing changes from these providers.

10. Termination

You may stop using BrokerBolo at any time. We may suspend or terminate an account that violates these terms, misuses WhatsApp/Meta's policies, or poses a security risk to other accounts. Data handling after termination follows our Privacy Policy.

11. Warranty disclaimer and limitation of liability

BrokerBolo is provided "as is," without warranties of any kind. We are not liable for lost leads, missed messages, or business outcomes arising from your use of the service, to the maximum extent permitted by law. Our aggregate liability to you is limited to the fees you have paid us in the preceding 12 months.

12. Governing law and jurisdiction

These terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.

13. Changes to these terms

We may update these terms as BrokerBolo changes. We'll update the effective date above when we do, and material changes will be communicated to account owners.
